  本研究は、研究対象となる時期を【Ⅰ】近代国際法完成期（1776～1914年）、【Ⅱ】戦間期（1915～1945年）に分類し、それぞれの時期における自然国際法論の代表的著作の検討を通して自然国際法論の展開史を解明し、【Ⅲ】両者の関係を整理した上で、同時代における一般法史学における「自然法の再生」との比較検討を行うことで、自然法論に関する国際法史研究と一般法史学研究との接合を目指すものである。
  研究期間の2年目に当たる本年度は、昨年度の成果も踏まえて、第一次世界大戦後の新たな国際法思想の潮流の一つとしての自然国際法論の「再生」に着目し、この担い手となった諸著作の検討・分析を行った。より具体的に言えば、第一次世界大戦後のドイツにおいて設立され、カトリック法学者によって構成された「キリスト教国際法のための委員会」の議論の成果物として刊行された叢書を渉猟し、分析することで、戦間期という時代にどのような自然国際法論が提唱されたのかという点を解明した。この叢書の存在は国内外の先行研究において看過されてきたものであり、これらを発見し検討の対象とすることじたいに研究上の意義があることは言うまでもない。

  「近代国際法における主権観念成立史研究――現代国際法学の再構成のために」と題する本研究は、国際法学における基礎的な観念の一つである「主権」が近代国際法（学）において成立する過程を国際法史及び政治思想史の観点から問い直すことを目的とするものである。
  昨年度に引き続き、政治哲学上の観念として生まれた「主権」観念がどのようにして近代国際法学に受容されたかを明らかにする作業に従事した。国際法学において、国家の「対外主権」を定式化したのは17世紀後半のヴァッテル（E. de Vattel）であると理解されてきたが、ヴァッテル以前の議論が彼の著作に与えた影響については明らかにされておらず、「主権者」と「国家主権」との観念的分離の問題も含めて、主権観念の内包を明らかにすることが求められるためである。また、このような作業の後に、近代国際法学の完成期に至るまでの間、ボダンやヴァッテルの主権理論がどのような形で受容されたかという点の解明に取り組んだ。
  このような検討から得られた成果は、昨年度と同様に、「主権」を論じるために主として「国家主権」にのみ着目してきた従来の国際法史研究を問い直すという意味で学術的な意義を有するものである。
